19-year-old charged with Sexual Misconduct with a Minor

FULTON COUNTY, Ind. -- Court documents from Fulton County reveal a 19-year-old man has been arrested and charged with Sexual Misconduct with a Minor, a Level 5 Felony, following a Dec. 22, 2025, report and investigation.

The suspect, identified as Brent Ross, had his initial hearing already and has a pre-trial conference set for May 12.

Documents state the Rochester Police Department received a call from the victim on Dec. 22, 2025, accusing Ross of raping her on either the night of Dec. 16 or morning of Dec. 17, 2025.

Police learned the victim had yet to tell her father about the incident. The father was soon notified of the report, and police also contacted the Department of Child Services.

The victim informed police on Dec. 16, 2025, Ross and another acquaintance had picked her up so they could go to the store together and hang out.

The three then went back to Ross' residence to watch movies together.

The victim stated after that, the three left to drop the acquaintance off before Ross then took her back to the apartment in Rochester around 10 p.m.

Ross allegedly brought up having sex with the victim multiple times while they were together. The victim said she refused multiple times.

At one point the two left to go to a gas station, where the victim believed Ross had bought condoms. Security footage later obtained from the Speedway gas station corroborated the purchase of condoms.

Once back at the apartment, the victim said Ross showed her his bed. That's when the two had sex, according to the victim.

The victim stated she didn't consent to this and that she felt pressured by Ross. The victim said Ross wore a condom.

Documents reveal after the two had sex, Ross called police/EMS due to him claiming to have heart issues. Ross was taken to the hospital and no issues were found.

The victim said after they had sex, Ross told her, "If you tell anyone about this, I will go to jail, and if I go back to jail, I will kill myself."

On Jan. 7, Ross was interviewed at RPD by investigators. Ross informed police he'd been in prison for a similar incident to what he's now accused of.

Police say Ross admitted to trying to have sex with the victim, but that they never did.

Ross informed police the evening of the alleged incident, he was intoxicated by marijuana and alcohol.

Ross claimed the victim kept asking him to have sex with her, but he kept telling her no that night.

Later in the interview, Ross explained to police that it was "most likely possible" he did have sex with the victim due to him being aroused and drunk.

Ross also told investigators if he went back to jail, he would kill himself, the same sentiment he allegedly told the victim.
