65-year-old charged with battery after allegedly kicking nurses

ELKHART COUNTY, Ind. -- The Elkhart Police Department reports officers responded to Elkhart General Hospital regarding the battery of a nurse by a patient on Saturday, around 11:11 p.m.

Upon arrival, authorities say thy made contact with the nurse who reported she'd been battered while taking care of a patient, later identified as 65-year-old Danny Hosler.

The nurse informed the police she was attempting to give Hosler a "banana bag," a medical treatment involving vitamins, and while she was walking past him, he kicked her in the right lower back/right side area.

The nurse said after she was kicked by Hosler, he struck her across her right breast and armpit area with the back of his forearm as she was walking past him to get out of the room.

The nurse then told police that Danny said he didn't want to be given narcotics as treatment.

Police say the nurse declined tech work, such as photos being taken for this incident.

The nurse told police Hosler was intoxicated, adding his BAC was .293 at the time.

Authorities say Hosler was restrained to his hospital bed at both ankles and both hands by EGH's soft restraints upon arrival.

Police say since Hosler was going to be arrested, the restraints were removed.

When his legs were taken out of the restraints, police say he kicked another nurse in the upper chest area below her chin.

The second nurse also declined tech work, including photos. The second nurse told police she witnessed Hosler kick the first nurse and told him not to hit her co-worker. The second nurse told police Hosler responded to her, saying he didn't.

Hosler was then secured by police and put in handcuffs. Due to Hosler's kicking and aggressive behavior, police placed shackles on his ankles.

Hosler was escorted to the Elkhart police transport vehicle and taken to the Elkhart County Jail. Hosler was medically cleared at EGH.

Hosler is charged with two counts of Battery against a Public Safety Official, both Level 6 Felonies.
