Compliance order finalized with Karl King Apartments and Portage Township

SOUTH BEND, Ind. -- The Indiana Attorney General has finalized a compliance order between Karl King apartments and Portage Township following a months-long investigation into unsafe living conditions at the property.

This compliance order stems from heating failures during sub-freezing temperatures in December 2025 and January 2026. 

Portage Township took action earlier this year against the property owner of Karl King.

The owner provided a 20% rent credit for those tenants affected with the heating failures. The property owner also provided documentation and reporting requirements related to building-wide health and safety issues. 

In the finalized state agreement approved by the Indiana Attorney General's Office, the property owner of Karl King must complete the following: 

  • The owner must complete significant boiler and heating system improvements by September 30, 2026
  • The property is subject to a multi-year monitoring period requiring detailed reporting on maintenance, safety, and capital improvements 
  • The owner must implement enhanced on-site security, including professional security services, functioning cameras in common areas, controlled access systems, and monthly incident reporting
  • The building must maintain a physically president on-site property manager to address resident concerns
  • The Attorney General retains the authority to inspect the property and enforce compliance if commitments are not met

The Portage Township Trustee's Office also released a statement following the finalized agreement. 

"We have a lot of work to do in South Bend to raise the overall quality of our housing," said Trustee Jason Critchlow. "Too many families are living in buildings where deferred maintenance, inadequate safety measures, and lack of accountability have become normalized. Protecting tenants, enforcing basic habitability standards, and ensuring landlords are meeting their responsibilities has to be a priority if we want a healthy, stable community."
