Drunk man leaves car to punch protester, gets charged with Battery and Public Intoxication

LA PORTE, Ind. -- A peaceful No Kings protest on June 21 in La Porte went relatively smoothly except for one incident that ended in a physical confrontation between a protestor and a person in a car passing by.
Two La Porte Police Department officers say they were parked in their patrol vehicles across the street from the protest, at the Northwest Health Building (901 Lincolnway), when they saw a man approach another man and punch him in the face.
"The two grabbed onto each other and fell to the ground," the LPD said.
"At this time, the rest of the crowd started to assist the victim with getting the male suspect off."
The two officers broke up the fight and identified the two men involved.
"After doing this, I looked over to see [my fellow officer] holding the suspect, later identified as Brian Foster, at taser point," the incident report states.
"With the scene safe at the moment, I returned to [the witness] and requested to know what had happened."
The witness told authorities that Foster had gotten out of a vehicle and approached the victim, demanding that he take down the upside down flag he was holding.
"The two exchanged words and Foster punched [the victim] in the face," the witness told police.
Officers asked the victim if they wanted to press charges and he did. Foster was arrested and charged with one count of Battery and one count of Public Intoxication.
"While at the jail, [Foster] informed [an officer] that he was in the passenger seat of his friend's vehicle when they observed the protest. Foster yelled out through the window to turn the flag the right way," authorities said.
"[The victim] yelled back profanities which angered Foster, who requested his friend let him out of the vehicle, to which he did."
The report states that's when Foster approached the victim and punched him in the face.
The LaPorte County jail staff requested that Foster blow into a Portable Breath test, displaying a BAC of .15.
