ELKHART COUNTY, Ind. -- A Goshen man will spend time in prison after being convicted of Neglect of a Dependent Resulting in Serious Injury.

35-year-old Nick Hunsberger was sentenced to three years in prison, followed by five years in the Elkhart County Jail, and then six years of probation (14 years, six suspended, 866 days of jail credit).

The initial incident happened in May 2022. Documents show Amanda Fahlbeck called dispatch to report that her two-week-old son was unresponsive. The baby was declared dead at the hospital shortly afterward.

According to documents, Fahlbeck told police she was sharing a bed with the victim, Hunsberger, and another child overnight. She allegedly said she knew it was unsafe for the baby to be in her bed, as she had lost a child to co-sleeping before.

Toxicology reports for both Fahlbeck and Hunsberger came back positive for amphetamine, methamphetamine, fentanyl, and norfentanyl. An autopsy of the victim found those same drugs in their system; the autopsy also determined that drug abuse and tobacco dependence on the hand of Fahlbeck, as well as unsafe sleeping conditions, contributed to their death.

Fahlbeck pled guilty for Neglect of a Dependent Resulting in Death. Her sentencing is set for September 17.
