Holmes makes first court appearance

CENTENNIAL, Colo. -- The suspect in the deadly rampage at a Colorado movie theater appeared in court.

Unshaven and with his hair dyed orange, James Holmes didn't say a word during his hearing and appeared dazed and sleepy.

He's accused of killing 12 people and injuring 58 others.

Charges have not been filed yet. But the lead prosecutor says she's considering the death penalty.

"There's so much that victims have to take into account and victims will be impacted by the that decision in an enormous way for years if, if the death penalty is sought," Carol Chambers, Arapahoe County District Attorney, said.

Holmes will be back in court on July 30.

He's been held in solitary confinement.
