Indiana State Police deny Mayor Neese's request for investigation into department

ELKHART, Ind. -- Indiana State Police denied Elkhart Mayor Tim Neese's request to investigate the Elkhart Police Department after two officers were charged with battery.

The two officers are accused of striking a man in custody while he was restrained. Police released surveillance video of the incident.

Out of concern for the public's confidence in the Elkhart Police Department, the mayor requested the ISP investigate the department.

Indiana State Police denied the request because the only thing they would have been able to investigate has already been resolved with charges against the officers.

ISP says an investigation into the department would be handled by the Department of Justice.
