Judge denies Ivery Cross' motion to withdraw guilty plea

NILES, Mich. -- A former Niles police officer, convicted of sexual assault, will not be allowed to withdraw his guilty plea.

A judge denied Ivery Cross' motion on Monday.

Cross confessed to sexually assaulting a teenager in 2011 in a police department bathroom.

He was sentenced to serve up to 15 years in prison.

Cross claims he got bad legal advice and did not know the punishment connected to the plea deal.

If the judge had granted the motion, Cross could have gotten a new trial.
