Judge denies Save Clay's effort to keep high school open

SOUTH BEND, Ind. - A district court judge overseeing a case between Save Clay, Inc. and the South Bend Community School Corporation has dismissed Save Clay’s efforts to keep the school open.  

The lawsuit was originally filed in the 1980s and focused on the desegregation of South Bend Schools.

Save Clay tried to re-open it, saying that by closing the school, the school district would be violating the original ruling’s requirement that all the schools must have at least 15% of the district’s total number of black students.

Court documents filed on Monday show the judge didn’t find any evidence of the district violating this ruling because South Bend Schools has yet to show a plan for how students will be divided.
