Man arrested after missing court hearing for three counts of Sexual Misconduct with a Minor

ELKHART, Ind. -- The Elkhart Police Department reports Josue Garcia was arrested on July 28 for failure to show up to his court hearing regarding his charges of three counts of Sexual Misconduct with a Minor-Def. has intercourse with or engages in other sexual acts, a Level 4 Felony, and Contributing to the Delinquency of a Minor, a Misdemeanor, which stem from 2021 incidents.
Court documents state the case was delayed several times over the years due to multiple competency hearings and subpoenas for doctors involved. Shortly after Garcia was found competent to stand trial in May 2024, he failed to show up to his hearing in June and an arrest warrant was issued.
EPD reports an Elkhart mother reported she was suspicious of Garcia having a sexual relationship with her then 15-year-old daughter. Garcia was 25 at the time.
According to documents, the victim admitted to having the relationship to her pediatrician.
In June 2021, the mother reported the victim as a runaway. Her whereabouts were then unknown for about a month. Garcia's family also stated they didn't know where he was at that time.
Case documents state the two had been in Odessa, Texas.
The two were located at Garcia's home in early July 2021.
The victim later admitted to running away with Garcia and that she had been willingly having sex with him.
In late July 2021, the mother reported the victim missing again.
In early August 2021, officers with the Homewood Police Department in Illinois located the two behind some condominiums after responding to a report of a suspicious vehicle.
Garcia initially gave the responding officer a false name before being identified.
