Marshall County Attorney sends cease and desist to county commissioners over Flock camera "bagging and tagging"

ABC 57

MARSHALL COUNTY, Ind. -- The Marshall County Attorney has submitted a cease-and-desist letter over recent developments in the county's Flock camera policy.

County Attorney Nelson Chipman submitted a letter to the Marshall County Commissioners, demanding they halt the "bagging and tagging" of the county's six Flock license plate readers under lease. That decision was followed by the County Council voting to end the county's contract with Flock; the council had also voted to defund the current contract.

In the cease-and-desist letter, Chipman characterized the commission's actions as "tyrannical" and "hastily chosen." He characterized bagging and tagging as requiring an agent or employee to effectively "seize and disable private personal property without due process of law."

Chipman says failure to abide by the letter could result in more action from his office.
