SBPD Merit Board terminates officer after being found guilty of Domestic Battery

SOUTH BEND, Ind. -- The South Bend Police Merit Board voted unanimously to terminate officer Emanuel Garcia on Tuesday.

This comes after Garcia was convicted and sentenced for Domestic Battery committed in the presence of a child less than 16 years old, a Level 6 Felony, and Resisting Law Enforcement-Defendant draws a weapon, a Level 6 Felony.

Garcia is no longer eligible to be an officer in the State of Indiana due to the specific charges he was convicted of.

He was notified of the situation on Sept. 17. Garcia has been on leave without pay, and no backpay will be given.

Garcia was sentenced for total of 2 years for Domestic Battery committed in the presence of a child less than 16 years old. He has a jail credit of 5 days and is suspended for 1 year and 360 days.

For Resisting Law Enforcement-Defendant draws a weapon, he was sentenced for a total of 2 years, with a jail credit of 5 days and is suspended for 1 year and 360 days.
