Supreme Court issues order related to UND contraceptive case

The US Supreme Court issued an order in the case of the University of Notre Dame vs Burwell and the Department of Health and Human Services regarding the contraceptive mandate of the Affordable Care Act.

The University of Notre Dame is fighting the contraceptive mandate which requires employers to provide contraceptives at no cost to insured employees. The university says as a Catholic university, the requirement is a violation of its religious beliefs.

On May 16, the Supreme Court order remanded the University of Notre Dame case to the US Court of Appeals for the Seventh Circuit in light of the decision in Zubik v. Burwell.

In the Zubik court opinion published on May 16, the Supreme Court did not make any decision about whether the ACA contraceptive mandate violates religious freedom laws. It remanded the case to lower courts for further proceedings.
