Triple murder suspect in court, defense requesting change of venue

ST. JOSEPH COUNTY, Ind. -- The attorney for a man who is facing a third trial on three counts of murder requested a change of venue in court Friday morning.

Wayne Kubsch is accused of killing his wife Beth Kubsch, Beth's ex-husband Rick Milewski, and 11-year-old Aaron Milewski, who was Beth and Rick's son, in Mishawaka on September 18, 1998.

Kubsch appeared in court via video conference Friday morning. His attorney informed the court they would be requesting a change of venue.

His attorney must file the motion for a change of venue by March 16 and the state has until March 26 to respond.

The next hearing in the case is scheduled for April 6.

This will be Wayne Kubsch's third trial for the murders.

Kubsch was first convicted and sentenced to death in 2000. That case was overturned by the Indiana Supreme Court.

His second trial, in March 2005, resulted in convictions on all three counts of murder and he was sentenced to death. In September 2016, that conviction was overturned by the Seventh Circuit Court of Appeals because critical evidence was not presented to the jury.
