MICHIGAN CITY, Ind. -- A 24-year-old man is facing several felony charges after allegedly shooting a man driving a Jeep at a BP gas station on July 11.

The suspect, identified as Daryl Rhodes II, is charged with two counts of Attempted Murder, as Level 1 Felonies, Attempted Murder, a Level 1 Felony, Aggravated Battery, a Level 3 Felony, Criminal Recklessness, a Level 5 Felony, and Unlawful Carrying of a Handgun, a Level 5 Felony.

Rhodes has had his initial hearing, and his next court appearance is Sept. 17.

According to the probable cause affidavit, on July 11, at around 8:20 a.m., officers with the Michigan City Police Department responded to a call at Franciscan Hospital for a gunshot victim.

The victim, who suffered a bullet graze to his head, told officers he and a woman were in his Jeep at the BP gas station at 1302 E Michigan Blvd. around 2 a.m.

The victim told police he and the woman went inside the store for something and when they exited and entered the Jeep, he heard approximately two to three gunshots along with the sound of a window shattering.

Once he realized they'd been shot at, the victim said he drove away from the scene.

The victim said he didn't realize he'd been injured until he stopped the car and sat for a minute. The victim said he didn't see who shot at them. The victim's passenger corroborated the sequence of events. The woman said she also didn't see who shot at them.

Later that same day, police viewed the security footage from the BP which showed the victim in the Jeep pulling into the station around 1:18 a.m.

At about 1:20 a.m., a gray Buick sedan pulled in along the driver side of the Jeep before pulling in front of it.

Police say a light skinned Black man then exited the Buick's rear passenger seat before approaching the driver side of the Jeep and smacking the windshield with a firearm

Investigators say the video then shows the Jeep begin to drive west as the man chases the Jeep, while raising the firearm and firing it.

Police say the footage shows what appears to be ricocheting bullets in the south portion of the BP parking lot.

Police say another Black man got out of the Buick's rear passenger seat before grabbing a firearm from the front seat passenger. This man is then seen running west toward the Jeep as well.

Investigators say the two men then got back into the Buick before heading north on the BP's east side. Police noted there was also a woman in the rear passenger area. The driver couldn't be seen from this camera angle.

Using a partial handicap license plate number from the Buick, MCPD utilized Flock cameras to track the suspect vehicle.

On July 14, a further review of the surveillance footage revealed audio of the woman in the back seat of the Buick saying, "OC, why are you doing stupid s***?"

After further audio and video review, the man seen firing the gun was identified as Rhodes, who goes by the nickname "OC."

Police say they also learned the woman in the victim's Jeep and Rhodes had been in an on and off again relationship.
