Man allegedly violates protection order, points gun at woman's head
ELKHART, Ind. - A man was arrested after he violated a woman's protection order against him and pointed a gun at her head, according to the Elkhart Police Department.
At 2:18 p.m. on Friday, police were called to the 1100 block of Whitfield Court after a victim said an unwanted person was inside her residence with a gun.
When officers arrived, they used a PA system to order the man out but didn't get a response back.
After several tries, followed by confirmation the man wasn't allowed to be in the apartment, officers got a key and went inside.
Inside, police found the man in a bedroom.
He was taken into custody without further incident.
Police also found a firearm in the house and removed it.
The victim said the man, identified as 23-year-old Cristian Gomez Benitez, went into her apartment without permission, as she has a protection order against him.
While inside, Benitez allegedly pulled out a firearm, pointed it at the victim's head and threatened her.
The victim was able to grab her two young children before getting out of the apartment.
Benitez was taken to the Elkhart County Jail on the charge of burglary while armed with a deadly weapon.
