Office of the Prosecuting Attorney releases new information into Officer-Involved Shooting that left a minor dead

ELKHART, Ind. -- On Wednesday, the Office of the Prosecuting Attorney released new information into the Officer-Involved Fatal Shooting in Elkhart County on Sunday, Feb. 8 to address "false information being disseminated" and other publicity about the event.

According to the Office of the Prosecuting Attorney, the investigation being carried out by the Elkhart County Homicide Unit is still underway, with interviews and a variety of forensic analyses left to complete and receive.

Neither the victim's name nor the names of anyone involved in the Officer-Involved Shooting will be released by the office, owing to the victim being a minor at time of death and threats of violence being made against officers and the victim's family.

After meeting with the victim's family and sharing information with them, the Office of the Prosecuting Attorney has gathered limited facts that can be released after having been corroborated. The released information is as follows:

After 1:30 p.m. on Sunday, Feb. 8, an officer was driving past the area of High Dive Park pavilion, noticing a running vehicle that was sitting still in the parking lot, despite the park being closed.

The officer pulled into the parking lot, watching the vehicle and seeing several individuals inside, including some who seemed to be minors. The officer then called for backup.

The officer spoke to the driver and "he made additional observations prompting further investigation pursuant to Indiana law". After this, the second officer showed up.

The officers attempted to gather the vehicle's occupants' identification. The officer was "led to believe" there were two 18-year-olds and three minors. The first officer returned to his vehicle to determine if there were any law enforcement notifications relating to the occupants.

The occupants were removed from the vehicle one by one for safety purposes. During this process, the 18-year-old driver didn't have identification on him and, when asked if he had any weapons, claimed "not right now".

As the backseat occupants were being removed, the front seat passenger reached between his legs and refused to put his hands up when ordered. He then turned, got out of the car, and fired a handgun.

The two officers then fired their handguns, fatally shooting the front passenger. A handgun was then on the ground near him.

Additional officers then arrived, the other occupants were secured, and first aid was provided to the front passenger until medics arrived and he was transported to the hospital, where he was declared dead. Throughout the process, no one else approached the front passenger or injured him any further.

Later, an investigation discovered another handgun, modified to be fully automatic, on the front passenger floorboard of the vehicle.
