Oregon-Davis School Board member facing multiple felony charges

STARKE COUNTY, Ind. -- An Oregon-Davis School District board member is facing multiple felony charges regarding the misuse of funds while he led the school's athletic boosters group.
Court documents show that 63-year-old Terry Minix, of Grovertown, has been charged with multiple counts of felony Official Misconduct, Fraud, and misdemeanor Theft.
An investigation was started in late February of this year when the Oregon-Davis School Corporation Police Chief requested the Starke County Sheriff's Department conduct an investigation into the Oregon-Davis Athletic Boosters (ODAB).
"The issues raised ... were that the ODAB were purchasing items not used at the concession stand, that there was a discrepancy in the amount of money the school had received during the time the athletic boosters ran the concession stand, and that the athletic boosters were using a tax exemption number belonging to the Oregon-Davis School concession stand," the probable cause affidavit for the charges states.
Part of the investigation involved receipts and invoices from Gordon Food Services that were from purchases made by the ODAB for items for the high school concession stand.
"[Oregon-Davis Superintendent Bill Bennett] stated he was concerned because there were items on these invoices that clearly did not have anything to do with the Oregon-Davis High School Concession stand, as well as the fact that a school tax identification number was being used to make purchases by the athletic boosters," court documents state.
According to Oregon-Davis Superintendent Bill Bennett, the high school concession stand has been operated by the athletic boosters, but control was given back to the school during the 2018/19 year by the then superintendent.
Between the 2018/19 school year and the 2020/21 school year, the school profited over $23,000 from the concession stand operations.
Bennett stated the athletic boosters took the program back over during the 2021/22 school year and have only raised $4,000 for the school's athletic department.
Concession profits turned into the Oregon-Davis School District:
- 2019: $6,060.96
- 2020: $9,936.91
- 2021: $7,032.59.
- 2022-25: $4,000
When a school board member requested the ODAB's bank statement Minix allegedly informed him that he had been in contact with his lawyers and those records could not be shared.
Through bank statements, receipts, and security footage from the Gordon Food Service check out, it was found that Minix had made multiple purchases, not only using the ODAB's funds, but the Oregon-Davis School District's tax exempt code.
"During this investigation, I received a current menu from the Oregon-Davis High School Concession stand. I found items in the nine mentioned invoices, as well as several other invoices, of items being purchased not related to the concession stand," the report states.
"These items included Bloody Mary mix, shrimp rings with cocktail sauce, apple juice boxes, meatballs, pasta (several types), turkey and provolone sandwiches, and cottage cheese. None of these items appear on the concession stand menu."
Also, after searching the Indiana Secretary of State business or entity look up, investigators saw no evidence that the ODAB has never been registered with the State of Indiana.
"Based on information obtained during this investigation, it appears that Terry Minix is currently the only authorized user of a bank card issued to the Oregon-Davis Athletic Boosters," the report states.
"The ODAB are not registered with the State of Indiana, and have no tax-exempt status. Based on nine videos and corresponding invoices, Terry Minix purchased items using the tax-exempt status of the Oregon-Davis Jr/Sr High School to make purchases for an unregistered organization, not connected to the school corporation."
Minix has been a member of the Oregon-Davis School Board since 2022.
