South Bend Common Council files notice of appeal in police tapes ruling
ABC 57 SOUTH BEND, Ind. -- The South Bend Common Council has officially filed a notice of appeal in the South Bend Police Tapes trial, sources tell ABC57.
This comes after last month's verdict in the St. Joseph County Superior Court that the tapes be destroyed. In 2012, the South Bend Common Council subpoenaed tapes of recorded conversations at the South Bend Police Department, believing they contained possible racist or illegal language and that they led to the improper ousting of then-Police Chief Darryl Boykins.
A St. Joseph County Superior Court judge ruled that the recordings violate Indiana and federal wiretap laws. The notice of appeal was filed Tuesday, beginning the appellate process and opening a case in the Indiana Court of Appeals.
