City of South Bend asks judge to send Dave Matthews bankruptcy case back to Indiana state court

SOUTH BEND, Ind. -- The city of South Bend is asking to have a high-profile bankruptcy case back in state court.

The city filed a brief requesting a judge to move the bankruptcy case of local developer Dave Matthews from federal court to Indiana state court. It says their goal is to get the case back on track for a trial later this year.

Back in March, "Matthews 350 East LaSalle" and "Commerce Center Development", LLC's both owned by Matthews, filed for bankruptcy. The case stems from delays in the East Race Market opening at the site of East LaSalle Apartments. Matthews's hope was to escalate the case to federal court, where he aimed to have the city quantify and justify their damages in a trial.

Matthews has not responded to this latest filing.
