Documents give details on Mishawaka High School sodomy

SOUTH BEND, Ind. – Five of the six Mishawaka High School students accused of sodomizing another student and fellow wrestler appeared in juvenile court on Monday.

ABC 57 was in the courtroom when individually each of the five accompanied by parents and/or guardians stood in front of Magistrate Harold Brueseke.
ABC 57 got a hold of the Petition Alleging Delinquency documents which show what the students are accused of doing.
The documents states that the event happened  “on or between February 1, 2010 and May 28th, 2010”, and they in some way participated in forcing an object between the victim’s buttock.
The documents state that the six did this by “bending the victim over, holding him down, and pulling down his shorts without consent”.
Four of the five entered a plea of denial. The fifth requested public defender and one was not available on Monday, so a plea wasn’t entered at all until a defender is officially assigned.
A status hearing was set for the last couple weeks in January for each of the five which are charged with Class B Felonies of Attempted Criminal Deviate Conduct.
A no contact order was given to all involved including with the other accused and the victim.
The magistrate said that no request has been field to move any of the cases to the adult system since many are considered adults now, but that is still an option for the prosecutor.
The accused were members of the Mishawaka High School Wrestling Team at the time of incident.
St. Joseph County Prosecutors Office said that at this time no other students were going to be petitioned at this time, but if other evidence came forward it could petition others.
