Elkhart man arrested after breaking into ex's home, taking shared 4-year-old son

ELKHART COUNTY, Ind. -- A local man allegedly broke into his ex-girlfriends house and took the son they share Saturday night before he was found and arrested at his parent's house later the same day.
Around 3:57 a.m. on June 21, an Elkhart County Sheriff's Office Patrolman was dispatched to the 58000 block of Old County Road 17 on reports of a man attempting to break into a residence and harm the resident.
"Dispatch also received a call from someone crying and not answering at the same location," the ECSO said.
When police arrived, they found and spoke with the victim who told them her ex-boyfriend, Mark Alvarez, was broke into her home and took the four-year-old child they share.
"[The victim] stated that Mark Alvarez, in a rude, angry, or insolent manner, dragged her around the house, causing pain, as well as using his arm while behind her to strangle her by applying pressure to her neck to the point that it impeded her breathing following a verbal argument over a dog," the ECSO said.
"[The victim] informed me that she attempted to leave but was stopped by Alvarez, who did not allow her to go by using his body to block the door."
Alvarez eventually did leave the house, but soon forced himself back into the residence and busted into the victim's room.
"After looking at the door that connected the living room to the garage, I noticed that the wood on the door was damaged, and a piece of the door was found on the floor in the living room," the ECSO said.
"I also noticed that the door to [the victim's] room was damaged as the wood around the lock was splintered and cracked."
The victim told authorities that while she was attempting to call 911, Alvarez forcibly took her cell phone and broke it, stopping her from continuing to report the crime.
"After inspecting her phone, I saw a cracked screen and damaged back casing," the ECSO said.
"Alvarez then left with his son in a green Subaru while intoxicated."
Alvarez was located and arrested at his parent's residence on E. Jackson Blvd.
Authorities say Alvarez refused to follow the officers' direct orders, and physical contact was made to ensure the safety of the officers involved and gain control of the suspect.
"Alvarez began to resist pulling away from officers physically and needed to be escorted to the ground," the ECSO said. "Alvarez was eventually taken into custody and taken to jail."
He was incarcerated for domestic Battery in the Presence of a Minor, Residential Entry, Strangulation, Criminal Confinement, Interference in the Reporting of a Crime, Criminal Mischief, Resisting Law Enforcement, and Neglect of a Dependent.
His bond is set at $100,000 and his first hearing is July 1.
