Fatal officer-involved shooting of Hannah Aberegg deemed justified

SOUTH BEND, Ind. -- The St. Joseph County Prosecutor's Office announced the officer-involved shooting which resulted in the death of 25-year-old Hannah Aberegg on May 6 was justified.

Specifically, the prosecutor's office states the shooting was justified as self-defense or in the defense of others.

The shooting happened May 6 at the Phillipps 66 gas station in the 3300 block of Portage Avenue. Officials say South Bend police officers were dispatched on a welfare check call put in by Aberegg's mother.

Police arrived on the scene and began speaking with Aberegg.

Officers had been advised Aberegg may be armed and while speaking with her, she became distraught and reached into her handbag. Police repeatedly told Aberegg to stop reaching into the bag.

Officials say that's when Aberegg pulled out the handgun and began raising it up. One officer then discharged his firearm, striking Aberegg's body.

Police on scene immediately attempted to render aid. Despite their efforts, Aberegg died from her injuries.

The officer who discharged his firearm was previously employed by the Mishawaka Police Department. Officers from the South Bend Police Department and St. Joseph County Police Department were also directly involved, which led to the Indiana State Police conducting the investigation.

After an extensive review of all the evidence, including video of the incident, the shooting was deemed justified by the prosecutor's office.

The St. Joseph County Prosecutor’s Office met with family members of Aberegg where they were able to review the video of the incident and discuss ISP's investigation. Afterwards, the family requested that the prosecutor's office not release the footage to the public. The prosecutor's office stated they will honor that request.

The prosecutor's office also noted while the criminal investigation is complete, the investigation and reports will now be given to SBPD to determine if any policies, procedures, or protocols were violated
