Goshen police address video recording in public spaces
GOSHEN, Ind. -- Goshen Police posted on social media, saying they are aware of a group of people they say have been walking through parts of the city, recording video outside of businesses and in public areas.
Police say “First Amendment Auditors” aim to test and exercise constitutional rights, including recording in public spaces.
Goshen Police say that while this may be concerning or uncomfortable for people, right now, they aren't violating any laws.
Additionally, they mention that Indiana law does permit open carry of firearms by people who are ”legally able to possess them.”
Goshen Police Department also listed the below reminders for people:
- They are allowed to record anything they can see from public property. This includes streets, sidewalks, and other areas open to the public.
- They must leave private property if asked to do so.
- Being recorded does not mean you are required to engage. You are not obligated to answer questions or participate in any interactions with them.
Karen Pletcher is a local business owner in Goshen. She says she hasn’t seen anyone doing this but appreciates police letting people know what's going on.
“They also said they have the right to do that, so I just figured I’m going to ignore them and let them do their thing unless they come in the building. And then maybe ask them to leave, because what I have inside is not their business,” said Pletcher.
She sees why this could make business owners feel uncomfortable.
“We kind of watch out for each other. And when you see someone kind of walking around, taking pictures of things or looking in places that we don't feel that they should, then we feel like we have to be more cautious,” said Pletcher.
Goshen Police say they are monitoring this situation, and if you feel threatened or think a law is being broken, call Elkhart County Dispatch at 574-533-4151.
