Residents file class action lawsuit against Hyperscale Data Center in Dowagiac
MGN DOWAGIAC, Mich. -- A Detroit-based law firm announced a class action lawsuit has been filed by two residents against the Hyperscale Data Center in Dowagiac.
Lawyers from Liddle Sheets, P.C., a nationwide class action law firm, say the two residents allege the data center is creating a nuisance by emitting consistent, disruptive noise throughout the neighboring residential area.
The suit also alleges 1,300 residential properties within a mile of the data center are similarly impacted by the facility's noise.
“My husband and I have been unable to use our yard since this facility began operating,” said Lindy Valenzuela, one of the named plaintiffs. “It is impossible to stay outside for longer than 10 minutes at a time before succumbing to headaches. The noise also penetrates the inside of our house even with the windows closed.”
The suit goes on to allege that residents have lost the ability to use and enjoy their property and is damaging property values.
The Hyperscale Data Center is located at 415 E Prairie Ronde St.
The facility became operational in early 2025.
The complaint states the noise is excessive and constant at all hours of the day, every day of the week.
