Burnett is due back in court on Sept. 11.
The Elkhart County Sheriff's Office reports deputies responded to the Arbors at Riverbend Apartments around 2:43 p.m. on March 24 for a reported shooting. Deputies arrived to find the victim, Lewis, on the ground with at least one gunshot wound.
Lewis was taken to Elkhart General Hospital where he later died from his injuries.
A deputy on scene observed a single spent shell casing in the parking lot, which was later learned to be a 5.7 caliber casing. Authorities said this is an uncommon caliber.
Deputies also collected two small bags containing possible marijuana as evidence from the scene.
Lewis' autopsy revealed his cause of death as multiple gunshot wounds, and the manner of death as homicide.
Through the investigation, deputies learned the victim's girlfriend had arranged a drug deal between Lewis and Burnett, the seller.
Documents state Burnett pulled up to the girlfriend's residence while Lewis was also out front.
That's when Burnett allegedly shot Lewis before driving off.
A witness also informed authorities they saw a Black man in white SUV arguing with a Black man in a black hoodie. The witness said he heard the man in the car yell, "I'll kill you!"
The witness said that's when he saw the man in the vehicle reach his arm out of the vehicle while holding a gun before shooting the other man in the chest.
Deputies later learned at the time of the shooting, Lewis had handgun on his person, but it was removed from him prior to law enforcement's arrival. Authorities say there was no evidence located to indicate Lewis fired this weapon during the shooting.
Deputies also obtained surveillance video from the apartment complex which showed the suspect vehicle leaving the complex south on Ash Road.
On March 24, the Elkhart County Public Safety Communications Center received a text message indicating a white SUV was parked in wooded area west of 56838 Spruce Ln. in Elkhart, and suspected it was related to the shooting.
Authorities said based off the location, it appeared as though someone had attempted to hide it or conceal the SUV's location.
Deputies arrived on scene and found the SUV unoccupied with the odor of marijuana coming from within.
Upon running the registration through the Indiana BMV, it was found to be registered to a relative of Burnett.
On March 25, a search warrant was executed for an unrelated investigation at a residence on Spruce Lane, an address which was also linked to Burnett. Deputies located a 5.7 holster, 5.7 magazine, and gun box for an FN Herstal Five-Seven. The actual firearm was not located.
