Elkhart County Jail: Braulio Amezquita ELKHART, Ind. -- A 27-year-old Elkhart man is charged with Attempted Murder, a Level 1 Felony, following an incident on June 29.
The suspect, Braulio Amezquita, had his initial court hearing Friday, where he was granted a public defender.
Amezquita's preliminary trial date is scheduled for Nov. 30.
According to the probable cause affidavit in the case, the Elkhart Police Department was contacted on June 29 regarding a domestic battery report.
The victim told police she was out of town while Amezquita was at her home watching her children. When she returned home, she said he was taking her belongings from the house and taking them to his place without her permission.
When the victim went to Amezquita's home and asked for her belongings, he told her to leave before allegedly picking her up and trying to physically remove her. This led to a physical struggle, during which Amezquita allegedly began to wrestle with the victim.
The victim states she tried to call 911 but he took her phone.
Amezquita then allegedly wrapped his right arm around her neck and placed her in choke hold, stopping her from being able to breathe. She stated Amezquita used his other hand to cover her nose and mouth.
The victim stated Amezquita also hit her on the right side of her face, at which point she bit down on his wrist, causing him to bleed. Once Amezquita released her, she began having a panic attack, according to documents.
The victim said she then tried to message her daughter via her smart watch. The victim said Amezquita forcibly removed the watch before covering her face with a nearby blanket.
The victim said Amezquita then placed a pillow over her face while she lay on the floor. The victim was able to escape the house, at which point Amezquita allegedly threw her belongings out the door before shutting it.
While at the EPD, the victim's injuries were photographed and noted.
The victim had a headache, and her injuries included redness on the right side of her face, bruising on her right wrist and inside of her right elbow, along with bruising on her right knee.
Due to her injuries, the victim was referred to St. Joseph Medical Center in for a Sexual Assault Nurse Examiner exam. Due to the severity of her injuries, the victim was taken to Loyola Medical Center in Chicago.
It was found she suffered dissection of both carotid arteries in her neck and was at great risk for stroke. The victim was treated and released.
Investigators made contact with Amezquita at his job in Elkhart, where he was subsequently arrested.
Amezquita told police he already provided a statement and would not speak with investigators any further.
