Case of mistaken identity lands 12-year-old behind bars

RENSSELAER, Ind. -- A case of mistaken identity landed a 12-year-old boy behind bars.

Jacob Magruder was sitting in the lobby at the Jasper County Sheriff's Department waiting for his family when an officer came up and booked him into a cell.

"I saw a police officer and he had a phone and he called in there and said, 'Is this the boy I'm suppose to take,' and the woman in there said, 'Yeah.' But they said 'I'm sorry it was just a misunderstanding,'" said Magruder.

Police patted him down and locked him into a holding cell for several minutes before the cops realized their mistake.

It turns out, they mistook Jacob for his 17-year-old brother.

The Jasper County Sheriff said an internal investigation is underway.
