Charges filed in December 27 stabbing

The St. Joseph County Prosecutor's Office filed formal charges in the stabbing reported on December 27 in South Bend.

Abel Miramontes is facing one count of battery by means of a deadly weapon for allegedly stabbing his cousin, Alexander Cervantes, in the leg.

South Bend Police were called about the stabbing at 4:09 p.m.

According to the investigation, Miramontes told police he thought Cervantes took his iPad, so he went looking for him.

Miramontes located Cervantes in an alley near McPherson Street. The two got into an argument, then began pushing and shoving.

Miramontes told police Cervantes got the better of him, so he pulled out a knife and stabbed Cervantes in the leg, according to the probable cause affidavit.

When Miramontes realized the severity of Cervantes' injury, he went to get help and took Cervantes to the hospital.

Cervantes was taken into surgery and was stable as of December 30.

The St. Joseph County Prosecutor's Office charged Miramontes with one count of battery by means of a deadly weapon on December 29.
