Gov. Braun signs BMV bill banning marijuana billboards

SOUTH BEND, Ind. -- Indiana Governor Mike Braun is taking aim at surround states' marijuana industries with a provision included in the recently signed House Bill 1390, which deals primarily with the Bureau of Motor Vehicles.
H.B. 1390 was authored by Jim Pressel and includes updates such as allowing the BMV to issue an electronic certificate of registration, issue a temporary registration permit at the bureau's discretion if a person meets certain requirements, and allows the BMV to offer alternative designs or color scheme versions of license plates.
Also included in H.B. 1390 is language that "Prohibits a person from advertising: (1) a product containing marijuana; or (2) a controlled substance listed in schedule I; by any medium."
The ban does provide a grandfather clause for contracts that are already in place.
According to Indiana Public Radio, Green Stem has three billboards in Indiana: two on State Road 933 and one on Cleveland Road. Lynch says he signed 10-year contracts for the billboards about a month ago.
“My three billboards in Indiana have been grandfathered for 10 years so I’m not taking them down,” Owner of Green Stem in Niles George Lynch said.
He will have to cancel an Indiana direct mail piece promoting a Memorial Day sale coming up, which were originally planned to go out to residents in South Bend, Mishawaka and Granger, where the store gets most of its Indiana customers.
