Rape charges against man in 2018 expunged

ST. JOSEPH COUNTY, Ind. -- A man, who was arrested for two counts of rape nearly two years after he was charged, has had his charges expunged.

In March 2018, Brenton Patterson went on a date with a woman he met the night before.

When the evening ended, he asked to go to her home and have another drink, reports said.

While at her home, Patterson went into the woman's bedroom without the woman's permission, reports said.

Patterson asked to have sex with her but the woman said no, according to the probable cause affidavit.

He was on top of her and although she tried to push him off, she was unable, reports said.

A Special Victim's Unit detective contacted Patterson 3 days later. Patterson said he was in Iowa and didn't know when he would return, reports said.

Patterson was charged with two counts of rape in October 2018.

Patterson, 32, was arrested on August 8, 2020.

In May 2021, Patterson was tried on the two counts of rape. A jury acquitted Patterson on both counts. His charges were later expunged.

UPDATE: This story has been updated to reflect that the man's charges were expunged.
