Murder suspect sentenced in sexual misconduct case

The man who is facing murder charges in the death of 15-year-old Desirae Jones was sentenced to 8 years in prison for sexual misconduct with a minor.

The judge ordered Fabian Rubio to serve six years with two years suspended.

He will also serve two years of probation once he is released.

He will have to follow sex offender terms for ten years.

Rubio admitted that between June 1 and June 30, 2014 he had sex with a 15-year-old girl.

In exchange for his guilty plea, the state dropped the rape charged and left the sentencing up to the judge.

Rubio remains incarcerated in the Marshall County Jail because of the pending murder charges.
