Second suspect sentenced for his part in 2023 homicide of 12-year-old

SOUTH BEND, Ind. -- Court documents from St. Joseph County Monday, reveal Amarion Cutler was sentenced to 25 years in prison after entering a plea agreement for his part in the Oct. 27, 2023, death of 12-year-old Josiah Small.

Cutler was originally arrested in November 2023 and charged with Murder-Aiding, Inducing, or Causing an Offense, Conspiracy to Commit Murder, a Level 1 Felony, two counts of Attempted Murder, Level 1 Felonies, two counts of Battery by Means of a Deadly Weapon, Level 5 Felonies, and two counts of Aggravated Battery, Level 3 Felonies.

Cutler took a plea agreement for the two charges of Aggravated Battery, Level 3 Felonies.

The first count resulted in a 9-year sentence with 7 more years for firearm enhancement. Cutler also has 664 days of jail credit for the first charge. The second count resulted in a 9-year sentence.

All other charges were dismissed.

The other suspect, Nagomba White, is set to be sentenced on Oct. 3 for his own plea deal in the case.
