Town marshal accused of unauthorized possession of women's underwear

ELKHART COUNTY, Ind. -- The Marshal of Millersburg was charged with two counts of criminal conversion related to the possession of women's underwear, according to the Elkhart County Prosecuting Attorney.


On Wednesday, 59-year-old David Keith Hathaway was charged with two misdemeanor counts of criminal conversion.


Conversion is the crime of exerting "unauthorized" control over another person's property.


A summons will be issued by the court for his appearance.


Indiana State Police investigated and determined that in October 2013 and February 2014, Hathaway maintained unauthorized possession of women's underwear, belonging to another, and for an unauthorized purpose.


The Millersburg Town Council has been advised of the charges.


Conversion is punishable by up to a year in jail and a fine of up to $5,000.
