Two men facing charges in the June 7 murder of Kristina Ortiz

SOUTH BEND, Ind. -- The St. Joseph County Prosecutor's Office announced two men are facing charges following the June 7 murder of 37-year-old Kristina Ortiz of South Bend near Southeast Park.

Court documents say Kristina was with her child at the time. St. Joseph County Prosecutor Ken Cotter says there were other families there as well.

“This was a family that was at a park with their child. There were other families who were at the park with their children. This was not one of those nighttime 2 o'clock in the morning parties,” said Cotter.

In the probable cause affidavit released by the prosecutor's office it states that South Bend police officers arrived in the 500 block of Wenger Street for a reported shooting.

They arrived to find Ortiz with a gunshot wound to the head. She was pronounced dead at the scene.

Jalil Aaron Wills has been charged with Murder, a Felony, and Criminal Recklessness, a Level 6 Felony. Nicholas Fairchild is facing felony charges for assisting a criminal.

The county prosecutor stated Ortiz was not the intended target and had no connection to the suspects.

Police collected witness statements, with one witness stating they saw a dark blue car pull into the parking lot of nearby apartments. They said a person then exited the passenger side to the car and went toward Wenger Street.

The witness said that's when they heard gunshots and saw the person running back to the car and flee the area.

Utilizing video footage from the area, authorities were able to locate the suspect vehicle and determine the owner of the vehicle as a relative of Nicholas Fairchild.

The car was seen minutes before the shooting driving on Wenger Street and was captured leaving the apartments' parking lot after the shooting.

Using more area video footage, the vehicle was seen at the University Park Mall before the shooting.

Wills and Fairchild were then identified in footage from inside the mall. Wills is also seen riding in the passenger seat of the suspect car.

In a press conference Friday, Amy Cressy, St. Joseph County’s Chief Deputy Prosecutor, said surveillance footage has helped in this case.

“I encourage anyone in the community who has video surveillance capabilities please contact the South Bend Police Department, become a part of this team,” said Cressy.

Wills was also wearing clothes that matched what witnesses described.

During the investigation, a search warrant was obtained for Wills' Instagram account.

Investigators located voice notes sent from Wills to another person on June 10. In the voice notes, Wills is allegedly heard stating he had fired a 19 Gen 5 gun and hit a woman in the head.

He further states he needed to trade the gun because it was "dirty," and that it was buried in the backyard.

A search warrant was obtained for a residence associated with Fairchild, and in the backyard, officers found a shovel near a hole. A gun was not recovered from the hole.

Casings from Wenger Street were collected and sent to SBPD's Ballistic Lab, which determined the casings were fired from a single firearm consistent with a Glock 9mm Gen 5.

Police say the casings also matched casings collected from other incidents involving Wills and Fairchild.

Wills and Fairchild were already booked in jail before these new charges were filed, and they remain in the St. Joseph County Jail at this time.

Wills was previously charged with Battery by Means of a Deadly Weapon, Criminal Recklessness Committed with a Deadly Weapon, and Criminal Recklessness Shooting a Firearm into a Building, regarding a case filed on June 14.
